The User and SOUL GLAMPING agree to submit to the exclusive jurisdiction of the courts of the county of Funchal the resolution of any legal issues resulting from the Terms of Use, without prejudice to the applicable mandatory legal rules. Notwithstanding the above, SOUL GLAMPING may apply precautionary measures (or equivalent type of urgent legal compensation) in any jurisdiction.

GENERAL BOOKING CONDITIONS

1. RESERVATIONS

1.1. When making any reservation, the Client must fill out the form correctly, indicating in particular, the accommodation, dates of departure, entry and exit and applicable tariff, always subject to confirmation of availability by SOUL GLAMPING, as well as your personal data and payment information, being fully responsible for the choices made and the information provided, which must be complete, true and current.

1.2. With the confirmation of the reservation data by the Client, he is assigned a reservation code, which must be referenced in all contacts with SOUL GLAMPING.

1.3. Likewise, the Client assumes full responsibility for the possession and / or obtaining of the necessary documents (such as identification documents,) for entry into the country and / or location where the Accommodation is inserted.

1.4. No refunds are payable for goods and / or services which, although made available to Customer, the Customer chooses not to enjoy or use.

1.5. Free cancellation if cancellation happens 30 days before checkin date.
50% refunded if cancellation happens 8 days before checkin date.

2. BENEFITS, PROMOTIONS AND DISCOUNTS

2.1. SOUL GLAMPING may make certain promotions ("Promotions") and discounts ("Discounts") on the Reservations made by Customers on the Site, with a limite or limited scope.

2.2. The following conditions apply to the Benefits, Promotions and Discounts:

1. I) The Benefits, Promotions and Discounts are subject to confirmation of availability;
2. II) The Benefits, Promotions and Discounts are only valid for reservations made through the Site and are not transferable to third parties;

III) In case of cancellation or non-use of a reservation made under a Benefit, Promotion or Discount, you will not be refunded with the value of the Benefit, Promotion or Discount, nor receive a guarantee of a reapplication in another reservation;

3. TAXES

4. ACCOMMODATION

4.1. The features of the accommodation are those included in the reservation. However, since the photographs of the accommodation were not taken on the day the reservation was made by the Client, there may be non-substantial differences between the photograph and the reality at the date of the enjoyment of the services contracted by the Client, which do not give the Client the right to Any modification of the Contract.

4.2. The prices shown are per accommodation.

4.3. Breakfast is included in the room rates.

4.4. Any and all damages due to reckless use of the accommodation will be the responsibility of the client.

4.5. In the event that the Client presents himself with more persons than those indicated in the reservation to use the Accommodation, those responsible for the accommodation may refuse entry.

4.6. If an overbooking situation occurs (ie, more reservations than available accommodations) in the accommodation reserved by the Client, the Client expressly acknowledges and accepts that SOUL GLAMPING may place you in another accommodation of the same undertaking, at no additional cost to the Client, and without, therefore, being entitled to any compensation or termination of the Contract.

4.7. As a general rule, the Accommodation can be used from 2:00 pm on the day of arrival and must be left free before 10:00 am on the day of departure (in both cases, at the time of your accommodation). The stay in the accommodation beyond the time of departure, may lead to the payment of additional amounts, which are the exclusive responsibility of the Client.

4.8. If the Client does not appear in the accommodation by 23:59 on the date of entry indicated on the proof of reservation, you may disregard the reservation and sell the Accommodation to third parties, for which SOUL GLAMPING cannot be held liable.

4.9. The Client shall comply with the internal regulations for the use of the accommodation, if any, and SOUL GLAMPING shall not be liable for damages suffered by the Customer as a result of the violation.

5. PAYMENT

5.1. The Client must pay the amount indicated on the booking form as a condition to be able to take advantage of the reservation.

5.2. Payment of the reservation can be made by the Customer (i) on the Site, on the date of the reservation or (ii) on the accommodation, on the date of entry (if this mode is available for the type of reservation made by the Client).

6. IMPOSSIBILITY OF COMPLIANCE

When SOUL GLAMPING is unable to comply with obligations arising from the Contract, for reasons that cannot be attributed to it, it must immediately notify the Client of such impossibility. If it is impossible for you to comply with any essential obligation, you may terminate the Agreement without penalty or accept in writing an amendment to the Agreement and any price variation. The Customer must notify SOUL GLAMPING of its decision within 4 working days upon recieving the notice from SOUL GLAMPING, if it understands and says nothing, than it agrees with the change.
